Sulzer Inter-Op Hip & Knee Implant — Class Action
This case involved 27,000 people who had received hip implants contaminated with benzene-containing motor oil. When a settlement was initially proposed that would have provided less than half the value of the case, Beth Klein objected — and appealed to the 8th Circuit Court of Appeals to ensure any resolution was truly fair to the people harmed.
The insurance policy involved was a “Pac-Man policy” — the more work defense lawyers performed, the less insurance remained for injured claimants. Beth and her team negotiated with Sulzer to stop the wasting of available insurance, and to issue shares in phases so a fully funded settlement could be achieved. She also insisted that all attorney fees be reduced to 20%, ensuring that the people harmed — not the lawyers — received the benefit of the recovery.
The result: a revised settlement valued at more than $1.25 billion — substantially more than the defendant-friendly original. Beth served on the national discovery and settlement team in this MDL litigation.
Dawson v. Fluor — Baghdad, Iraq Burn Verdict
This case stands alone in Beth Klein’s career — and arguably in Colorado legal history. Her client suffered life-altering burns due to the negligence of a military contractor operating in Baghdad during the Iraq surge. The obstacles to prosecuting this case were immense: witnesses were located in an active war zone, testimony required negotiation with the emerging Iraqi government, and ICE and Homeland Security had to be navigated to bring that testimony to a United States courtroom.
Beth overcame every one of these obstacles — traveling internationally, locating former Iraqi workers, and building a case that no one thought could be won. The trial, held in Dallas County — the home of the contractor — resulted in an $18.78 million verdict for her client.
The verdict was named Case of the Year by the Colorado Trial Lawyers Association and entered into the Texas Verdict Hall of Fame. It is the kind of result that defines a legal career.
Propane Explosion — Products Liability
A propane-related explosion caused serious, life-altering injuries to Beth Klein’s client. Cases involving gas explosions — propane, natural gas, and related appliances and infrastructure — require specialized knowledge of both products liability law and the technical mechanics of gas systems, ignition sources, and equipment failure.
Beth Klein has extensive experience in this specific area, having handled numerous cases involving gas grill explosions, propane tank malfunctions, gas line failures, and related appliance defects. This case resolved for $10 million — one of the largest explosion-related product liability settlements in her career.
Ski Resort Premises Liability — Colorado Mountain Injury
Ski resort liability cases in Colorado are uniquely challenging. Resorts frequently invoke the Colorado Ski Safety Act and pre-signed waivers in an attempt to shield themselves from responsibility for dangerous conditions on their properties. Beth Klein understands the specific legal landscape of mountain resort litigation — and the exceptions and limitations that apply to these defenses.
This case resolved for $2 million — demonstrating that serious resort injuries are not automatically barred from recovery, and that the right attorney can identify and pursue viable claims even in heavily defended cases.
Human Trafficking Victim from Nepal — Civil Trial Verdict
A young woman was trafficked to the United States and deceived into believing she would become a nurse. Her captor demoralized her and forced her into prostitution. After she was slashed with knives and brought to an emergency room, she was finally rescued from captivity — and Beth Klein took her case to trial.
The $7 million verdict was obtained against the traffickers — using civil litigation as a tool for justice in one of the world’s most serious human rights crises. This case exemplifies Beth Klein’s commitment to representing the most vulnerable people, in the most difficult circumstances, and holding perpetrators fully accountable in a court of law.
PIP Insurance Bad Faith — Largest Verdict of Its Kind in Colorado
After an insurance company denied coverage for serious injuries sustained by Beth’s client — a clear act of bad faith and delay by the underinsured motorist carrier — Beth Klein took the case to trial and won. The $2.1 million verdict was the largest PIP bad faith verdict in Colorado history at the time it was obtained.
