How Long Do I Have to File a Personal Injury Claim?

The length of time you have to file a lawsuit in Colorado is called the statute of limitations. For personal injury, product liability and malpractice, the statute of limitations is two years. This time can begin to run from the date the injury occurred or when the injury was discovered since some injuries or conditions don’t present themselves immediately. If the injury was caused by a car or truck accident, the statute of limitation extends to three years. In Colorado wrongful death cases must be filed within two years of the date of the death.
